The use of this website means that you are agreeing to accept the terms and conditions of use. These terms and conditions can be printed out by selecting print from the file menu of your browser.

"You" means the person using the website

By using the website you confirm that you are at least 18 years old, or, if you are under 18, that you are accessing the website with the consent of your parent or guardian.

Under no circumstances shall Hamilton Jewellery be liable for any indirect, special, incidental or consequential damages of any kind, regardless of the form of action, whether in contract, tort (including negligence), strict product liability or otherwise, even if we have been advised of the possibility of such damages pertaining to the website and related items.

You may not copy, reproduce, distribute, republish, download, display, post or transmit any part of the website without written consent from us. Images or content from this website may be printed out for legitimate use relating to Hamilton Jewellery.

The images on the site are for informational purposes only and are automatically protected under UK copyright law.

We reserve the right to make changes to our website, policies, and these Terms and Conditions at any time. You will be subject to the policies, Terms and Conditions in force at the time that you use the website or that you order goods from us, unless any change to those policies or these conditions is required to be made by law or government authority (in which case it will apply to orders previously placed by you). If any of these conditions is deemed invalid, void, or for any reason unenforceable, that condition will be deemed severable and will not affect the validity and enforceability of any remaining conditions.

Very occasionally information displayed on our site may be incorrect due to system errors. We will of course make every effort to avoid errors but if they do occur we will not honour inaccurate or erroneous prices.

Our prices may be subject to change without notice.

Every attempt has been made to ensure that the Jewellery displayed on www.hamiltonjewellery.co.uk is as accurate as possible, however some products may appear larger or smaller than their real size and variations in colour may occur. The product dimensions supplied are intended to give only an approximate indication of the size of individual products.

Payment

We accept all major credit and debit cards via our third party hosted secure payment system.

Delivery

Shipments dispatched remain our responsibility until received by the recipient. Hamilton Jewellery is not responsible for Jewellery where delivery has been attempted but the delivery company obtained no signature.

Damaged or tampered shipments must have the word 'DAMAGED' written by the receiving person on the delivery agent's paperwork. Failure to do this will result in the shipment becoming uninsured and Hamilton Jewellery cannot accept responsibility for this.

Delivery Charges

UK

For orders up to £50 we post using Royal Mail Signed For service at a charge of £2.50.

For orders from £51 up to £200 we post using Special Delivery at a charge of £5.00

Orders over £201 will be posted using Special Delivery free of charge to the customer.

International

International orders will be sent by Airsure at a cost of £8.00, please allow up to 14 days for delivery. Jewellery shipped internationally may be liable to tax or duty charges applied by the recipient's country's customs. This is out of Hamilton Jewellery's control and is something we cannot accept responsibility for. Any additional charges (i.e. customs charges) incurred when arriving in your country will be at your cost.

Out of stock items

We try our best to constantly have a supply of all the goods shown on our site but instances will occur when items ordered are out of stock. In such cases we will notify you of any items that are not in stock on the date of your order. Any out of stock item will be made and delivered to you within 2 weeks of the order. If this is not possible (i.e. materials have to be ordered in to complete the order) we will contact you to discuss an accurate delivery date or you will be given the option to cancel the order and receive a full refund.

Losses

We will not be held responsible for any delay or failure to comply with our obligations under these conditions if the delay or failure arises from any cause that is beyond our reasonable control. This condition does not affect your statutory rights.

Returns

If you are not completely satisfied with your Jewellery please contact us by email or using the contact us form before sending the item back. We will send an email that should be printed and packed with the return items. All items must be returned in original unworn condition and packaged equal to the original packaging. Returns must be sent within 7 days of receipt for a full refund (minus postage costs). Return postage costs are the liability of the customer. We recommend returns be posted a minimum of Royal Mail Signed for, this allows you to track the package, it does NOT insure the Jewellery. If the return is of high value, we recommend you post it Special delivery to ensure it is insured against loss. Jewellery returned remains the responsibility of the customer until received back by Hamilton Jewellery.

Exemptions

Commissions – individually designed pieces or altered pieces are non-returnable unless faulty.
Due to health and safety legislation earrings are non-returnable unless faulty.
Our returns policy does not affect your statutory rights.

Complaints

If you have a complaint about our service please contact us via our contact us form and we will do our utmost to reply and resolve the issue as soon as possible. We will keep you informed as to the steps being taken to resolve your issue.

Waiver

If you breach these terms and conditions and we take no action, we will still be entitled to use our rights and remedies in any other situation where you breach these conditions.

Privacy policy

Information given to us will be treated in accordance with the data protection act.
We do not collect any personally identifiable information from visitors to our website and cannot identify visitors in any way.

If you contact us via the website, we will store your email address to enable us to answer your query. We will not disclose your email address to any third party. We will hold your personal information as long as we require it. We will delete your personal information upon request from you.

If you place an order with us we will only disclose your personal information to legitimate third parties in order to fulfill the order, for example courier or credit card companies. We will not disclose or sell any personally identifiable information to anyone else. The only exception to this would be for the investigation of fraud or to comply with any applicable law, regulation, legal action or government request.

We keep a database of past customers and occasionally email or post information about events, discounts or new Jewellery products. If you would prefer not to be included in this database please contact us and we will remove your name.

To comply with the Data Protection Act we take every precaution to keep your personal information secure.
